This policy explains what personal information OPS Logistics collects, why we collect it, who we share it with, how long we keep it and what rights you have over it. It applies to this website and to the shipping services we provide.
A summary, not a substitute. The numbered sections below are the policy; if the two ever disagree, the detailed sections govern.
Names, addresses and contact details of senders and recipients, plus details of what is being shipped. Without these a consignment cannot legally cross a border.
Carriers, agents, and customs authorities in the origin, transit and destination countries. This is not optional — it is how international shipping works.
If you ship to another country, information about that shipment goes there too. Section 7 sets out the safeguards that apply.
Customs and tax law sets minimum retention periods for shipping records, and they are longer than most people expect. Section 8 sets out the periods and what drives them.
Including access, correction and deletion, subject to the record-keeping obligations above. Section 10 sets out how to exercise them.
Privacy questions get a real answer from a person. Contact details are in section 13.
OPS Logistics provides international freight forwarding, express courier and supply chain services. For the purposes of data protection law, the controller of the personal information described in this policy is OPS Logistics, of 4463 Camino De La Plaza, San Ysidro, CA 92173, United States.
Our head office is at 4463 Camino De La Plaza, San Ysidro, CA 92173, United States. If you are in the European Economic Area or the United Kingdom, enquiries about this policy should be directed to the contacts in section 13.
We collect the following categories of personal information:
We use personal information to:
Where data protection law requires us to identify a lawful basis for processing, we rely on the following:
Cookies are small files placed on your device when you visit a website. We use them in the following categories:
A current list of the individual cookies in each category — name, purpose and how long each lasts — is available in the cookie settings on this site. We keep that list there rather than in this document because it changes more often than the policy does.
Where cookies are not strictly necessary to make this site work, they are set only with your consent, and that consent is asked for before they are set rather than announced afterwards. You can change or withdraw your choice at any time through the cookie settings on this site, and you can block or delete cookies through your browser settings — though parts of the site may not work correctly if you do.
Shipping cannot be performed without disclosing information to other parties. We share personal information with:
We do not sell personal information for money, and we do not sell the personal information of anyone we know to be under 16.
California law also treats certain disclosures to advertising partners as "sharing" for cross-context behavioural advertising, even where no money changes hands. Where any such sharing happens through advertising or measurement tools on this site, you can opt out by declining marketing cookies in the cookie settings, or by contacting us using section 13. We will not treat you differently for opting out.
Because we move goods internationally, information about a shipment necessarily travels to the countries involved in it. Those countries may not provide the same level of data protection as your own.
Where a transfer is necessary to carry out the shipping contract you have entered into — for example sending delivery details to an agent in the destination country — we rely on that necessity. For other transfers we rely on an adequacy decision covering the destination country where one exists, and otherwise on standard contractual clauses or an equivalent approved safeguard. You can request details of the safeguard applying to a particular transfer using section 13.
We keep personal information for as long as needed for the purpose it was collected, and for as long as customs, tax and commercial law require. Those statutory periods are frequently longer than the commercial relationship.
We maintain technical and organisational measures appropriate to the risk, including access controls that limit personal information to staff who need it for their role, encryption of data in transit to and from this website, written agreements and due diligence on the providers who process data for us, and training for staff who handle customer information.
No system is completely secure. If a breach occurs affecting your rights, we will notify you and the relevant authority where the law requires it.
Depending on where you live, you may have some or all of the rights set out below. We will not treat you differently for exercising them.
To make a request, contact us using the details in section 13. We may need to verify your identity first, and we will respond within the period the applicable law allows. Before we act on a request we need to be satisfied you are who you say you are, so we may ask for information that lets us match the request to our records — usually a shipment reference or the email address we hold. Where the EU or UK GDPR applies we respond within one month, which may be extended by up to two further months for complex requests, and we will tell you if it is. Where California law applies we respond within 45 days, extendable once by a further 45 days.
Some rights are limited where we are legally required to retain records — a customs declaration cannot be deleted on request. Where we cannot action part of a request, we will tell you which part, and why, rather than simply declining the whole thing. If you are not satisfied with how we have handled a request you can complain to a regulator: in California, the California Privacy Protection Agency or the California Attorney General; in the United Kingdom, the Information Commissioner's Office; and in the EEA, the data protection authority for the country where you live or work.
Our services are directed at businesses and adults. We do not knowingly collect personal information from children. We do not knowingly collect information from anyone under 13 in the United States, or under 16 in the EEA and United Kingdom where a member state has not set a lower age. If we become aware that we hold information about a child collected without the appropriate consent, we will delete it. If you believe a child has given us information, tell us using section 13 and we will act on it.
We may update this policy. The version number and dates at the top of this page show when it last changed. Minor changes take effect when published here. Where a change materially affects how we use your information or the rights you have, we will give notice on this site and, if you hold an account with us, by email before it takes effect. Previous versions are available on request.
For any question about this policy, or to exercise a right described in section 10, contact us at info@opslogistic.com or +1 858-428-7703, or write to us at 4463 Camino De La Plaza, San Ysidro, CA 92173, United States.
Please mark privacy enquiries clearly in the subject line so they reach the right team quickly rather than being handled as a general enquiry.
Which of these apply depends on where you are and which law covers you. Ask and we will tell you which ones you have rather than making you work it out.
Ask for a copy of the personal information we hold about you and what we do with it.
Have inaccurate information fixed and incomplete information completed.
Ask us to erase information, subject to records we are legally required to keep.
Limit how we use it, or object to processing based on our legitimate interests.
Receive information you gave us in a portable format, or have it sent to another provider.
Withdraw consent, unsubscribe from marketing, and opt out of any sale or sharing of your information.
If something in this policy is unclear, or you want to know what we hold about a shipment you were the recipient of rather than the sender, just ask. You do not need to cite a regulation to get an answer.
